Understand the difference between the two things from the expressions that follow 「は」(a form showing contrast), 「場合」(the case), and 「ほうは」(a form showing contrast) are reversed in form, as in affirmation and negation.

In the following recording, negation form as in 「著作物にあたらない」(is not copyrighted work) and affirmation form as in 「著作物にあたる」(is copyrighted work) that follow 「は」(a form showing contrast) are used, which explains the difference between 「アイデア」(idea) and 「小説」(novel) that precede 「は」(a form showing contrast).
